This form must be filled out by all persons directly participating in live stage events and shows at FANTASM.

FANTASM 2022 Participation Terms and Conditions, General Liability Release and Waiver

• All participatory ("Participant") attendees for live stage events and shows of FANTASM must complete this form in order to participate on stage in Main Events at FANTASM. This form must be completed, signed and delivered to the Event organizers prior to the start of the Event. Incomplete forms will not be accepted.
  
  
• This form must be completed using the Participant's full and legal name; otherwise, the form will be invalid, not be accepted, and the Participant may not participate.
  
  
• If applicable, a parent or legal guardian must fill out and sign the Parent or Guardian's Additional Release for Minors for participants who are not 18 or over.
  
  
• For the purposes of this form:
  • I am aware that audio-visual video or film recordings and photographs (Photos and Footage) of FANTASM and its participants are created or recorded by Encompass Entertainment, LLC. and Encompass Entertainment, LLC. - approved industry and media representatives.  Photos and Footage are created in public areas, contests, panels, booths, and elsewhere at FANTASM Events.  Such footage may be used in a highlights tape, marketing endeavor or any other use.
    
    
  • I consent to such recording of me, my voice, and likeness, and any costumes or accessories I may be wearing or have with me while I am participating in FANTASM for the duration of FANTASM.
    
    
  • I grant to Encompass Entertainment, LLC. and FANTASM the rights to reproduce, display, distribute, perform, create derivative works from, license, sub-license and otherwise use any Photos or Footage, in whole or in part, of me, my likeness, my voice, and my costume or accessories in any media and in any manner throughout the world in perpetuity, including on the Internet, broadcast, satellite and other transmissions, including but not limited to in highlight tapes and other promotional and marketing materials concerning Encompass Entertainment, LLC. or FANTASM without any compensation to me whatsoever.  I further understand and agree that Encompass Entertainment, LLC. has no obligation to create Photos or Footage of me, or to make any use of such Photos or Footage if they are created.
    
    
• The information disclosed below will be used only in conjunction with the Event and for historical purposes of documenting the Event in which the Participant is participating.  Participants should expect their first and where necessary, last name will be used to identify them publicly.

  In consideration of being permitted to participate in any Event organized, operated or sanctioned by FANTASM and Encompass Entertainment, LLC., I (the 'Participant') hereby acknowledge and agree to the following terms and conditions of participation:
  
  
  • I have read, understand, and agree to abide by the FANTASM Code of Conduct, Prop/ Weapons Policy, and other FANTASM policies and procedures posted on the website at https://www.fantasmofficial.com/index.cfm?ID=11.
    
    
  • I understand and agree that the FANTASM Code of Conduct, Prop/ Weapons Policy, and other FANTASM policies and procedures, and the terms and conditions of participation set out in this form, are effective and apply to me at all times when I am present on and around DoubleTree by Hilton Hotel at the Entrance to Universal Orlando and Official Hotels during FANTASM.  The duration of FANTASM, for signees of this waiver, is defined to be from 08/19/2022 12:00 am until 08/21/2022 11:59 pm.
    
    
  • I acknowledge and agree that by completing this form, acceptance of any badge, pass, or other form of admission issued by Encompass Entertainment, LLC. and/or FANTASM for entrance into FANTASM constitutes acceptance of agreement to the following:
    
    
    • I am aware that audio-visual video or film recordings and photographs ('Photos and Footage') of FANTASM and its participants are created or recorded by Encompass Entertainment, LLC. and Encompass Entertainment, LLC. - approved industry and media representatives.  Photos and Footage are created in public areas, contests, panels, booths, and elsewhere at FANTASM Events.  Such footage may be used in a highlights tape, marketing endeavor or any other use.
      
      
    • I consent to such recording of me, my voice, and likeness, and any costumes or accessories I may be wearing or have with me while I am participating in FANTASM for the duration of FANTASM.
      
      
    • I grant to Encompass Entertainment, LLC. and FANTASM the rights to reproduce, display, distribute, perform, create derivative works from, license, sub-license and otherwise use any Photos or Footage, in whole or in part, of me, my likeness, my voice, and my costume or accessories in any media and in any manner throughout the world in perpetuity, including on the Internet, broadcast, satellite and other transmissions, including but not limited to in highlight tapes and other promotional and marketing materials concerning Encompass Entertainment, LLC. or FANTASM without any compensation to me whatsoever.  I further understand and agree that Encompass Entertainment, LLC. has no obligation to create Photos or Footage of me, or to make any use of such Photos or Footage if they are created.
      
      
• I do hereby fully and completely release FANTASM, Encompass Entertainment, LLC., DoubleTree by Hilton Hotel at the Entrance to Universal Orlando, Official Hotels and the City of Orlando from any and all harm, liability or damage from any personal injuries or property losses that I may suffer arising out of or connected with, my participation in any and all Events.
  
  
• I hereby acknowledge and agree:
  
  
  • I understand that the Events in which I will participate are of a voluntary nature. I further understand that some of the Events, such as but not limited to dancing or role playing, may be inherently dangerous and may cause serious or grievous injuries, including bodily injury, damage to personal property and/or death. I understand the nature of the Events and represent that I am qualified to participate in such Events. I further acknowledge that I am aware that the Events will be conducted in facilities open to the public. I agree and warrant that if at any time I believe conditions to be unsafe I will immediately discontinue further participation in the Events.
    
    
  • I hereby freely and voluntarily assume any and all risks of participation in FANTASM, and take full responsibility and waive any claims of personal injury, death or damage to personal property associated with my participation in FANTASM Events or presence on the premises where the Events are held, including, but not limited to, engaging in activities such as: lifting or carrying objects, dance contests, matches of any kind, collapse or faulty construction of a stage or riser, product liability, any contests for money, prizes or entertainment purposes, stays in Official Hotels, consumption of Encompass Entertainment, LLC. - or FANTASM - provided meals or food, or any and all other activities on and off the premises.  This WAIVER & RELEASE will continue in full force and effect even after the conclusion of the Events, on the premises of, or for the benefit of Encompass Entertainment, LLC. or FANTASM, and after the conclusion of my participation or presence on the Events premises, whether by agreement, by operation of law, or otherwise.
    
    
• In the Event of any injury or illness to me during my participation, I authorize the staff of FANTASM, Encompass Entertainment, LLC., DoubleTree by Hilton Hotel at the Entrance to Universal Orlando, and Official Hotels to seek and obtain such emergency or medical services as may be deemed necessary at the time, but understand and agree that they shall not be obligated to do so.
  
  
• I understand and acknowledge that if I break, deface, harm or damage any equipment or portion of the premises at which FANTASM takes place, including, but not limited to, DoubleTree by Hilton Hotel at the Entrance to Universal Orlando, Official Hotels, and the City of Orlando, I shall be solely and personally responsible for paying any and all costs and consequential damages relating to the replacement or repair of the damaged item or facility.
  
  
• This WAIVER & RELEASE contains the entire agreement between me and Encompass Entertainment, LLC. or FANTASM, and supersedes any prior written or oral agreements between us concerning Encompass Entertainment, LLC. or FANTASM.  This WAIVER & RELEASE is binding on my heirs, my executors, administrators, my personal representatives, and me.  The provisions of this WAIVER & RELEASE may be not be waived, altered, amended or repealed, in whole or in part, except with written consent of all parties. If any provision of this WAIVER & RELEASE is determined to be unenforceable, that provision shall be severed, and all other provisions shall remain in effect. It shall be construed under Florida law without regard to its conflicts of law principles, and I consent to the jurisdiction of courts in Orlando, Florida. I have read, understand and fully agree to the terms of this WAIVER & RELEASE. I understand and agree that by signing this WAIVER & RELEASE I have given up considerable future legal rights. I have signed this Agreement freely, under no duress or threat of duress. I further have been advised that I have a right to seek independent counsel of my choice about these matters and the rights waived and released by this document, and by my signature below represent and warrant that I have done so, or have chosen not to do so, and hereby waive my right to do so or to claim that I did not understand this document. I further agree to indemnify and hold harmless FANTASM and Encompass Entertainment, LLC. from any and all Claims which are brought by or against me, and which are in anyway connected with my participation in the Events.
  
  
• My signature below establishes that I have carefully read this agreement, that I fully understand the same, and is proof of my intention to execute a complete and unconditional WAIVER & RELEASE of all liability to the full extent of the law. Any electronic signatures of this document that are included by email or any other type of data transfer are considered binding in the same effect as a written signature. I am 18 years of age or older and mentally competent.

I further agree to indemnify and hold harmless FANTASM and Encompass Entertainment, LLC. from any and all claims which are brought by, or on behalf of the Minor, and which are in anyway connected with the Minor's participation in the Events.
